These Terms and Conditions (“Terms”) govern the provision of investigative and related services by Expat Investigations(“we,” “us,” “our”) to clients (“you,” “your”). By engaging our services, you agree to these Terms.
1. Scope of Services
Expat Investigations provides professional investigative services within the boundaries of applicable law in Spain, the United Kingdom, and other relevant jurisdictions. Services may include surveillance, tracing, research, technical counter-surveillance, and related assignments as agreed in writing or electronically.
2. Legal Compliance
All investigations are conducted in compliance with national and European data protection laws, privacy legislation, and professional ethical standards. Clients must not request any actions that are illegal, unethical, or in violation of these laws. We reserve the right to decline or terminate any instruction that may contravene applicable legislation.
3. Client Responsibilities
You confirm that you have a lawful reason for instructing our services and will provide accurate information necessary to carry out the investigation. Any material misrepresentation or omission of relevant facts may result in termination of the assignment.
4. Fees and Payment
All fees are quoted exclusive of taxes unless stated otherwise. Estimates are based on the information provided at the time of instruction and may vary if circumstances change. Invoices are due upon receipt unless alternative payment terms are agreed in writing. Late payments may incur additional charges.
5. Confidentiality
All information obtained during an investigation is treated as strictly confidential and shared only with the instructing client unless disclosure is required by law. We maintain secure storage and handling of client data in accordance with data protection principles.
6. Reporting and Evidence
Reports and evidence supplied are based on information obtained through lawful and reasonable means at the time of the investigation. While every effort is made to ensure accuracy, we cannot guarantee outcomes or conclusions drawn from third-party data or surveillance observations.
7. Data Protection
We process personal data solely for the purpose of performing investigative work and maintaining business records. Please refer to our Privacy Policy for details on how we collect, use, and protect personal data.
8. Limitation of Liability
Expat Investigations shall not be liable for any indirect, consequential, or incidental loss arising from the performance or non-performance of our services. Our total liability for any claim shall not exceed the total amount paid for the specific instruction giving rise to the claim.
9. Termination
Either party may terminate an engagement by providing written notice. Fees will be payable for all work undertaken up to the date of termination. Retainers are non-refundable unless otherwise agreed in writing.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales, and where applicable, Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of those jurisdictions.
11. Amendments
We may update these Terms from time to time to reflect changes in legislation or operational practice. The latest version will always be available on our website.
